What are human rights?
Human rights are universal legal guarantees that protect individuals and groups against actions that undermine fundamental freedoms and human dignity. They are inherent to all human beings, without distinction of nationality, place of residence, sex, national or ethnic origin, color, religion, language, or any other status. It is incumbent upon States to respect, promote and protect human rights effectively.
Human rights and fundamental freedoms are enumerated in the Universal Declaration of Human Rights and in various treaties (called covenants and conventions), declarations, guidelines and sets of principles. They include a wide range of guarantees that address virtually every aspect of human life.
They are non-transferable, non-waivable and inalienable: no one can waive or bargain away his or her rights. Nor can the State dispose of citizens’ rights; in extreme situations some rights may be temporarily limited, but never denied.
Human rights; state obligations to promote, respect, protect and ensure
We already know that human rights are inalienable rights of every human being, but how can we access them? Where can we find evidence that they have been officially recognized by states? And how are they enforced?
The state’s duty to respect, promote, protect and guarantee primary rights is paramount and therefore regional or international subsidiary courts come into play when the state continuously or deliberately violates these rights. We are all familiar with examples of how recourse to regional and international mechanisms has become necessary for the recognition of violations occurring at the national level. Regional and international concern or assistance can be the trigger for securing rights at the national level, but it is only undertaken when domestic avenues have been used and exhausted. For this reason we want to devote the remainder of this section to exactly this scenario. What recourse is there in securing adequate protection for the enjoyment of human rights when domestic systems have failed?

El pleno cumplimiento de las sentencias emitidas por la Corte Interamericana de Derechos Humanos sería una prueba del buen funcionamiento del Sistema Interamericano de Derechos Humanos. Sin embargo, es posible detectar la presencia de ciertos factores que impiden la plena aplicación de estas sentencias. Derivado del análisis de todos los casos en los que el Estado mexicano ha sido condenado por la Corte Interamericana de Derechos Humanos, se proponen algunas estrategias que buscan fortalecer el cumplimiento de dichas sentencias de la Corte. La ejecución de las sentencias que emite la Corte Interamericana de Derechos Humanos representarían una evidencia del buen funcionamiento del Sistema Interamericano de Derechos Humanos. Sin embargo, es posible constatar la presencia de ciertos factores que obstaculizan el pleno cumplimiento de esos fallos. Derivado del análisis de cada uno de los casos donde el Estado mexicano ha sido sentenciado ante la Corte Interamericana de Derechos Humanos, planteamos algunas estrategias que apuntan a fortalecer el cumplimiento a esas sentencias.

We understand that it is possible to make mistakes and that you do not intend to violate our policies. Therefore, the first violation usually only results in a warning. Please note that this will only happen once and the warning will remain on the channel. If you violate the Community Guidelines again, you will receive a foul. Occasionally, a single instance of serious abuse will result in the channel being closed without a warning. You can appeal the warning if you think we made a mistake.
