The United States has filed an intervening complaint against Doctor’s Choice Home Care Inc, Timothy Beach and Stuart Christensen alleging violations of the False Claims Act stemming from the alleged payment of kickbacks in the form of sham medical director agreements and payments to the referring physicians’ spouses, the Justice Department announced today.

“Kickbacks and other improper remuneration that interfere with the medical decision-making process undermine the integrity of our health care system,” said U.S. Attorney Maria Chapa Lopez.  “My office will continue to aggressively pursue those who violate these laws and compromise our system of care.”

The lawsuit alleges that Doctor’s Choice, with the knowledge of Beach and Christensen, paid kickbacks in the form of bogus medical directors to three physicians to refer patients to Doctor’s Choice.  The three physicians allegedly did little or none of the work for which Doctor’s Choice paid them as medical directors.  The sham medical director agreements to induce patient referrals violate the Anti-Kickback Statute and the Stark Law.  Doctor’s Choice also allegedly paid some employees in a manner that accounted for the volume of referrals from their physician spouses, in violation of the Stark Law.

The False Claims Act governs whistleblower claims and was originally created during the Civil War to prevent government suppliers from abusing their financial relationship with the military.

The False Claims Act law can be difficult to understand. Having a qualified attorney guide you through the process can be beneficial in helping you determine whether or not you have grounds for a whistleblower case.

In some whistleblower complaints, the government may intervene in your complaint, which is often a beneficial situation. If the government joins a case, there is often a greater chance of success than when it does not intervene. In this type of intervention, government attorneys generally take control of the case and may choose to dismiss the case, pursue and prosecute the case, or settle the case.

The most common causes of whistleblower lawsuits include defrauding Medicare and/or Medicaid and defense contractor fraud. Private citizens, often employees of companies that commit fraud against the government, are an important part of the U.S. government’s effort to combat fraud and waste of taxpayer money.

There are several ways a whistleblower lawsuit can go. A whistleblower can bring a whistleblower lawsuit against a company on behalf of the government. The government is considered the plaintiff in the action.

To help protect the whistleblower, the lawsuit is usually sealed and kept private even to the defendant in the case under the qui tam provisions of the False Claims Act. This helps protect the whistleblower, especially if he or she is still employed by the defendant or works in the same field.

The False Claims Act provides protection for those who bring a claim on behalf of the government. Under the Act, a whistleblower who is an employee of the defendant company cannot be fired, demoted, harassed or otherwise discriminated against for filing a whistleblower claim.
