Law 21/1992, of July 16, 1992, on Industry, establishes in its article 12.5, that the Industrial Safety Regulations of state scope will be approved by the Government of the Nation, without prejudice that the Autonomous Communities with legislative competences on industry, may introduce additional requirements on the same matters when dealing with facilities located in their territory.
The current regulations on the storage of chemical products are constituted by Royal Decree 379/2001, of April 6, which approves the Regulation on the storage of chemical products and its complementary technical instructions MIE APQ-1, MIE APQ-2, MIE APQ-3, MIE APQ-4, MIE APQ-5, MIE APQ-6 and MIE APQ-7, by Royal Decree 2016/2004, of October 11, 2004, which approves the Instruction on the storage of chemical products and its complementary technical instructions MIE APQ-1, MIE APQ-2, MIE APQ-3, MIE APQ-4, MIE APQ-5, MIE APQ-6 and MIE APQ-7, by Royal Decree 2016/2004, of October 11, which approves the Complementary Technical Instruction MIE APQ-8 “Storage of ammonium nitrate-based fertilizers with high nitrogen content” and by Royal Decree 105/2010, of February 5, which modifies certain aspects of the regulation of chemical product storage and approves the Complementary Technical Instruction MIE APQ-9 “storage of organic peroxides”.

Article 2°.- The Superintendency is empowered to promote, with individual or collective, national or foreign persons, projects for the Construction and Operation of LPG Forklift Plants. Likewise, it is the function of the Superintendency to comply with and enforce compliance with the Laws, Rules and Regulations in force in the sector, pursuant to Article 10 of the Law of the Sector Regulation System (SIRESE).
Article 3°.- Individual or collective persons hereinafter referred to as Companies interested in the Construction, Operation and Commercialization of LPG wholesale through LPG Bottling Plants, shall comply with the provisions of these Regulations.

Article 12°.- The companies interested in the construction and operation of plants of LPG crimping for commercialization, shall contemplate in their projects with the following basic infrastructure:
